By accessing or using FieldOps ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
FieldOps is a real-time field operations mapping platform provided as a subscription-based Software-as-a-Service (SaaS) application. The Service is provided by Design-Build-Live, LLC ("Company"), Wardensville, West Virginia.
Department administrators are responsible for managing access to their department's FieldOps instance. You are responsible for maintaining the confidentiality of your access PINs and for all activity under your account.
You agree to use FieldOps only for lawful purposes and in accordance with these Terms. You shall not: (a) use the Service to store or transmit illegal content; (b) attempt to gain unauthorized access to any part of the Service; (c) reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service; (d) copy, reproduce, modify, or create derivative works based on the Service or any part thereof; (e) resell, sublicense, or redistribute the Service without written consent from the Company.
FieldOps, including its design, code, features, workflows, user interface, documentation, and all related materials, is the exclusive property of Design-Build-Live, LLC and is protected by copyright, trade secret, and other intellectual property laws. All rights not expressly granted herein are reserved. Unauthorized reproduction, distribution, or use of any portion of the Service is strictly prohibited and may result in civil and criminal penalties.
You retain ownership of all data you enter into FieldOps. We do not sell, share, or disclose your data to third parties except as required by law. Data is stored on Google Cloud infrastructure (Firebase) and transmitted over encrypted connections.
Paid subscriptions are billed monthly through Square. You may upgrade, downgrade, or cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.
FieldOps is a field coordination tool and is NOT a certified life-safety, emergency dispatch, or 911 system. It should not be relied upon as the sole means of communication, navigation, or decision-making during emergency operations. GPS positions are approximate and must be verified independently. The Company assumes no liability for operational decisions made based on information displayed in the Service.
We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage resulting from service interruptions.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. THE COMPANY'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Design-Build-Live, LLC, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance. Material changes will be communicated through the app or via email.
These Terms are governed by the laws of the State of West Virginia. Any disputes shall be resolved in the courts of Hardy County, West Virginia.
